Terms and Conditions – RNG Design FZE

1. Company Details

2. General

• We endeavour not to make any mistakes; however, please check the product specification, compatibility with your vehicle, and anything else relevant to your purchasing decision with your RNG Design FZE representative before placing an order.
• RNG Design FZE will provide you with all manuals, documentation and certificates of conformity received from us or our suppliers in relation to your products.
• Jurisdiction and governing law. It is agreed between the contracting parties that all disputes arising out of any contracts or agreements entered into will fall under the jurisdiction of the courts of Sharjah, United Arab Emirates, and will be governed by and construed in accordance with the federal laws of the United Arab Emirates and the applicable regulations of the Sharjah Publishing City Free Zone. This jurisdiction clause applies to the extent permitted by mandatory UAE consumer protection laws; nothing in this clause shall deprive a consumer of any mandatory statutory rights.
• Ownership of products. The products do not belong to the customer until they have been paid for in full with cleared funds.

3. Deposits and Pre-payments

• 50% deposit. A deposit equal to 50% of the total order value is required with every order to show the customer’s commitment to purchase the products and RNG Design FZE’s commitment to supply the products. Any payment made in excess of this 50% deposit will have been individually negotiated between RNG Design FZE and the customer; this usually occurs with orders subject to heavy bespoke modification.
• Acceptance of these terms. Placing an order and/or making a deposit constitutes acceptance of RNG Design FZE’s Terms and Conditions.
• Non-payment or non-collection. If the customer fails to pay the outstanding balance of the agreed purchase price without lawful reason by the agreed date, or fails to arrange collection or delivery of the products by the agreed date, RNG Design FZE will be entitled to treat the agreement as cancelled by the customer and offer the products for re-sale. RNG Design FZE will be entitled to claim from the customer any reasonable losses suffered, which may include, but are not limited to, stocking charges, unrecoverable extras or custom work carried out on the products, and any reduction in value of the products. All such losses will be evidenced in writing, and any excess amount held by RNG Design FZE after deduction of such reasonable losses will be refunded to the customer.
• Balance payment. Once RNG Design FZE notifies the customer that their order is completed and ready for collection or dispatch, the balance of the invoice is payable no later than 7 days from notification of completion.
• Use of the deposit. RNG Design FZE will be entitled to use the deposit and any pre-payment to reduce its reasonable losses. Any excess will be returned to the customer and any shortfall will be paid by the customer.
• Delivery dates. Handover/dispatch dates are indicative and RNG Design FZE cannot be held responsible for delivery delays caused by the base vehicle manufacturer, component manufacturers, shipping agents or other third parties. RNG Design FZE will use reasonable efforts to meet the indicated dates but shall not be liable for delays caused by third parties outside its reasonable control.

4. Warranties / Faulty Products

• Warranty period. RNG Design FZE products (including body kits, forged wheels and accessories) supplied by RNG Design FZE are covered by a 12-month parts warranty from the date of delivery or installation (whichever is earlier), unless otherwise stated. This warranty does not exclude any mandatory statutory rights available to the customer under applicable UAE law, including rights relating to hidden defects or consumer protection.
• OEM parts. Any warranty claims relating to OEM parts of the base vehicle must be handled directly with the vehicle manufacturer or authorised dealer; RNG Design FZE cannot process or control such claims.
• Retro-fitted products. Where RNG Design FZE products are retro-fitted to a vehicle, a 12-month parts warranty applies to RNG Design FZE products only.
• Branded products. Branded products supplied by RNG Design FZE are covered by a 12-month manufacturer’s warranty. Any repairs and replacements will be carried out in accordance with the manufacturer’s terms after the product has been returned.
• Unbranded products. Unbranded products supplied by RNG Design FZE are covered by a 12-month manufacturer’s warranty against faults and defects.
• Notification of defects. Any claim by the customer based upon defects in the quality or condition of the products supplied, or workmanship where applicable, shall be notified to RNG Design FZE within a reasonable time of the date of delivery, or, where the defects were not apparent on a reasonable inspection, within a reasonable time after discovery of the defects.
• Intended use. RNG Design FZE parts are designed for day-to-day road use and are not covered against damage from heavy off-road use or excessive submersion.
• Transport damage. Damages caused by delivery companies or shipping agents must be rejected at the time of delivery or signed for as “damaged”. RNG Design FZE cannot be held responsible for, or claim for, any damages that are not documented by the delivery driver.
• Returns and inspection. All defective products must be returned to RNG Design FZE for inspection. RNG Design FZE does not offer an advance replacement service for defective products. This does not affect the customer’s statutory rights under UAE consumer protection laws.
• Fitting. Products must be fitted by RNG Design FZE or an RNG Design FZE-approved technician. Any defects or damage caused by incorrect fitting will not be covered under warranty. This warranty exclusion applies only where the defect or damage is proven to result from incorrect fitting.
• Purchases through resellers. Products purchased through an RNG Design FZE independent reseller must be returned via the original route of purchase.
• Transferability. Product warranty is not transferable.
• Vehicle maintenance. RNG Design FZE products installed on vehicles carry a 12-month warranty, irrespective of items covered by the vehicle manufacturer’s warranty period. Vehicle owners must adhere to the vehicle manufacturer’s guidelines on service and inspections. Failure to maintain a vehicle within the specified guidelines may negate cover on products installed by RNG Design FZE.
• Vehicle manufacturer’s warranty. RNG Design FZE products are outside of vehicle manufacturer specifications and are not endorsed by the manufacturer. As such, the vehicle manufacturer’s warranty may be affected on certain parts by RNG Design FZE modifications. A main dealer may not honour warranty repairs if they believe the cause of the fault is an aftermarket modification. RNG Design FZE will not be held responsible for any costs incurred with manufacturers, main dealers or any other third party for repairs.
• ECU remapping. ECU remapping is not supported by vehicle manufacturers or main dealers. A main dealer may not honour warranty repairs if they believe the fault has been caused by changes made to the ECU. ECU remaps are installed at the owner’s risk and RNG Design FZE will not be held responsible for disputes or repair costs incurred with manufacturers and main dealers. Nothing in this clause excludes liability for proven negligence or wilful misconduct by RNG Design FZE.
• Exclusions. Wear and tear damage and light impact damage to alloy wheels are not covered under warranty. The parts warranty does not cover breakages to items that are subject to adjustment or replacement during normal service or maintenance operations.

5. Miscellaneous

• Severability. If any provision of these Terms and Conditions is held to be invalid or unenforceable under applicable UAE law, the remaining provisions shall continue in full force and effect.
• Consumer rights. Where mandatory UAE consumer protection law grants additional rights to a customer acting as a consumer, those rights shall prevail over any conflicting provision in these Terms and Conditions.
• Data protection and contact. RNG Design FZE processes personal data in accordance with applicable UAE data protection laws. For any questions or complaints regarding these Terms, customers may contact RNG Design FZE at the address stated above.
